Flixfer respects intellectual property rights and expects users of our Services to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and equivalent international copyright laws, we will respond to valid notices of claimed infringement.
1. Reporting Infringement
If you believe that content available through Flixfer infringes your copyright, please submit a written DMCA takedown notice to our designated agent at:
- Email: [email protected]
- Subject line: DMCA Takedown Notice
2. Required Information
Your DMCA notice must include all of the following to be valid:
- Identification of the copyrighted work — Describe the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
- Location of infringing material — Provide the specific URL(s) on Flixfer where the allegedly infringing material is located. This must be specific enough for us to locate the content.
- Your contact information — Include your full name, mailing address, telephone number, and email address.
- Good faith belief statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement — A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the copyright owner.
- Signature — A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
3. Our Response
Upon receipt of a valid DMCA notice, we will:
- Acknowledge receipt of the notice within 72 business hours.
- Remove or disable access to the allegedly infringing material expeditiously.
- Notify the user who uploaded the material that their content has been removed.
- Provide the uploader with information about the counter-notice procedure if appropriate.
4. Counter-Notices
If you believe your content was removed due to a mistake or misidentification, you may submit a counter-notice to the same contact above. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement consenting to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Flixfer may be found.
Upon receipt of a valid counter-notice, we may reinstate the removed content after 10–14 business days, unless we first receive notice that the complainant has filed an action seeking a court order against the uploader.
5. Repeat Infringers
Flixfer has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We reserve the right to terminate access for any user who receives multiple valid DMCA notices.
6. Misrepresentation
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
